Terms of Service

Welcome to Sparkle. These Terms of Service ("Terms") govern your access to and use of the Sparkle website at getsparkle.video and the personalized video service we provide (the "Service"). The Service is operated by Łukasz Smacki (operating as Sparkle), Pułaskiego 19a, Katowice, Poland ("Sparkle", "we", "us", "our").

By purchasing, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who May Use the Service

The Service is intended for purchase and use by adults aged 18 or older. The videos we create are made for children, but the Service must be purchased, set up, and operated by a parent, legal guardian, or other responsible adult. By using the Service you confirm that you are at least 18 years old and that you have the authority to provide any information you submit about a child.

You are responsible for all activity that occurs under your account or order.

2. What the Service Does

Sparkle generates personalized videos in which an original fictional animated character speaks directly to a named child for a chosen occasion (such as a birthday, an achievement, or an encouraging message). You provide limited inputs — typically the child's first name and optionally a short personalization message — and we generate a unique script and a rendered video featuring one of our characters.

We offer the following products:

• Sparkle Standard Video — a personalized video delivered in 720p HD.
• Sparkle Premium Video — a personalized video delivered in 1080p Full HD, including a printable keepsake.

Each video is generated uniquely per order. Characters, their companions, scripts, voices, and visual assets are our original creative works.

3. How the Service Is Built (AI Disclosure)

Sparkle is an independent product and service. To generate scripts and render videos, the Service uses third-party artificial intelligence models and infrastructure providers through our own custom interface and pipeline. We are not affiliated with, endorsed by, or sponsored by the providers of those underlying AI models, and their trademarks remain the property of their respective owners. References to any model or provider, if made anywhere on our site or in our materials, are for descriptive purposes only.

The characters in our videos are original fictional animated characters created by Sparkle. The Service does not perform face-swapping, deepfakes, or manipulation of the likeness of any real person.

4. Orders, Pricing, and Payment

Prices are displayed on getsparkle.video and are shown in U.S. dollars. Current pricing is $12 for a Sparkle Standard Video and $24 for a Sparkle Premium Video. Prices may change, but the price shown at the time of your purchase is the price that applies to that order.

Payments are processed by our Merchant of Record, Creem. When you make a purchase, Creem (or its affiliated entity) is the seller of record for that transaction, handles billing and tax, and may appear on your card or bank statement. Your purchase is also subject to Creem's applicable terms. Receipts and billing-related communications may be sent by Creem on our behalf.

5. Delivery

Videos are generated after your order is received and are delivered by email to the address you provide, typically as a link to view and download your video. Generation is automated and usually completes within a short time, but delivery times are estimates and not guaranteed. It is your responsibility to provide a valid, monitored email address and to check spam or filtered folders. Download links may expire after a limited period; please download and save your video promptly.

6. Refunds and Support

If something goes wrong with your order — for example, the wrong name was rendered due to our error, the video failed to generate, or it was not delivered — contact us at and we will work to resolve it. We aim to respond to all customer requests within 3 business days.

Because each video is custom-generated for a specific child and occasion at the time of purchase, orders are generally non-refundable once the video has been successfully generated and delivered, except where required by law or where the issue resulted from our error or a failure of the Service. Requesting changes to a correctly fulfilled order (for example, choosing a different character after delivery) may require a new purchase.

7. Your Inputs and Acceptable Use

You are solely responsible for the information and content you submit, including any child's name and any personalization message ("Your Inputs"). You represent that you have the right and authority to submit Your Inputs, including the right to use any child's name you provide, and that Your Inputs are accurate and lawful.

Acceptable Use Policy

This Acceptable Use Policy is a binding part of these Terms. When using the Service, you must not submit any input, or attempt to cause the Service to generate any content, that:

• is sexually explicit, pornographic, NSFW, sexually suggestive, or that sexualizes, endangers, or exploits a minor in any way;
• depicts, references, or facilitates child sexual abuse or the grooming, endangerment, or harm of any child;
• is hateful, harassing, threatening, defamatory, or that promotes violence or discrimination against any person or group;
• is intended to impersonate a real, identifiable person, or to create a deceptive likeness of any real individual;
• is illegal, promotes illegal activity, or infringes the intellectual property, privacy, or other rights of any person;
• attempts to bypass, disable, or interfere with our content moderation, our providers' safety systems, or the technical operation of the Service.

We screen submitted inputs through automated content moderation before any video is generated. We may, at our sole discretion and without refund, reject any order, refuse to generate any video, or terminate access where an input violates this Acceptable Use Policy or these Terms.

You agree not to generate, request, or attempt to generate NSFW, sexually explicit, or sexually suggestive content of any kind through the Service. This prohibition applies regardless of context and is a material term of these Terms.

8. Intellectual Property

All characters, character companions, names, scripts, artwork, audio, video templates, software, and other materials that make up the Service are owned by Sparkle or its licensors and are protected by intellectual property laws.

When your video has been generated and paid for, we grant you a personal, non-exclusive, non-transferable, worldwide license to view, download, keep, and privately share the delivered video and any included keepsake for personal, non-commercial purposes (such as showing it to your child, family, and friends). You may not resell, sublicense, commercially exploit, or use the video or our characters to create derivative products, or claim ownership of our characters or underlying assets.

9. Privacy and Children's Information

Our handling of personal information, including the limited information you provide about a child, is described in our Privacy Policy, which is incorporated into these Terms by reference. You confirm that you are the parent or legal guardian of, or are otherwise authorized to provide information about, any child whose name or details you submit.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that generated content will meet your subjective expectations. Generated scripts and videos are produced by automated systems and may contain variations or imperfections.

11. Limitation of Liability

To the maximum extent permitted by law, Sparkle and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, goodwill, or profits, arising out of or related to your use of the Service. To the maximum extent permitted by law, our total aggregate liability for any claim arising out of or relating to the Service or these Terms will not exceed the amount you paid for the order giving rise to the claim.

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited.

12. Indemnification

You agree to indemnify and hold harmless Sparkle and its operators from any claims, damages, liabilities, and expenses arising out of Your Inputs, your use of the Service, or your breach of these Terms or the Acceptable Use Policy.

13. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date reflects the most recent version. Material changes will be posted on this page; your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. Termination

We may suspend or terminate access to the Service at any time if you breach these Terms or the Acceptable Use Policy, or where required to protect the Service, other users, or any child.

15. Governing Law

These Terms are governed by the laws of Poland, without regard to its conflict-of-laws rules. The courts of Poland will have jurisdiction over any dispute arising out of these Terms, except where mandatory consumer-protection law provides otherwise.
