Privacy Policy

This Privacy Policy explains how Sparkle ("we", "us", "our"), operated by Łukasz Smacki (operating as Sparkle), Pułaskiego 19a, Katowice, Poland, collects, uses, and protects personal information in connection with the Sparkle website at getsparkle.video and our personalized video service (the "Service").

The Service is purchased and operated by adults (parents or guardians). We take the limited information provided about children seriously and handle it as described below.

1. Who This Policy Covers

We are the controller for the personal data we collect about visitors to our site and customers of our service. Our merchants of record, Paddle.com Market Ltd and Creem, are independent controllers of the payment data they collect from you at checkout.

This Policy covers visitors to our website and customers who purchase a personalized video. It also covers the limited information a customer provides about a child for the purpose of generating that child's video. We do not knowingly allow children to purchase or independently use the Service; the Service is directed at and must be used by adults.

2. Information We Collect

Information you provide to create a video. To generate a personalized video you provide a small amount of information, which typically includes:

  • A child's first name (and, where you choose, a short personalization message or occasion details).
  • The selected character, occasion, and product tier.
  • An email address for delivery of the video.

We ask you to provide only the minimum information needed to personalize the video. Please do not submit a child's full name, home address, school, contact details, photographs, or any other unnecessary personal or sensitive information — these are not required and should not be entered.

Order and payment information. Payments are processed by our merchants of record, Paddle.com Market Ltd and Creem, whichever one handles your order. That merchant of record collects and processes the payment and billing information needed to complete your transaction (such as billing details and card information). We do not collect or store full payment card numbers. We receive limited order confirmation information from Paddle.com Market Ltd or Creem, as applicable (such as the fact and amount of a successful purchase and the associated email).

Technical information. Like most websites, we and our infrastructure providers may automatically collect limited technical data such as IP address, browser type, device information, and basic usage data, including through cookies or similar technologies, to operate, secure, and improve the Service.

Cookies. We use essential cookies and local storage to run the order flow, self-hosted analytics to see how the site is used, and Meta advertising cookies to measure how our ads perform. You can block or delete cookies in your browser settings, and opt out of interest-based advertising in your Meta ad settings.

Server-side advertising measurement. In addition to the Meta advertising cookies described above, we send advertising measurement events to Meta directly from our servers using the Meta Conversions API. Because these events are sent from our servers rather than from your browser, blocking cookies in your browser does not prevent them. See "How We Share Information" below for what is shared with Meta, and "Your Rights" for how to object to this processing.

3. How We Use Information

We use the information described above to:

  • generate, render, and deliver the personalized video you ordered;
  • screen submitted inputs through automated content moderation before any video is generated, to keep the Service safe;
  • send you transactional communications, such as the delivery email containing your video link, and respond to support requests;
  • process and confirm your order through our Merchant of Record;
  • operate, secure, debug, and improve the Service and prevent fraud and misuse;
  • comply with legal obligations.

We do not sell personal information. We do not use a child's name or your inputs for advertising, and we do not build marketing profiles of children.

4. Legal Basis for Processing

Where the GDPR applies, we process your data to perform our contract with you, by creating and delivering the video you ordered and providing support; for our legitimate interests in securing the service, preventing fraud and improving the product; with your consent, for marketing emails and non-essential cookies; and to meet legal obligations, such as accounting and tax records.

5. AI Processing of Your Inputs

To generate scripts and render videos, the information you submit for an order (such as the child's first name and any personalization message) is processed through automated systems, including third-party AI model and infrastructure providers that we use through our own pipeline, and through a content moderation step. These providers process the inputs on our behalf to produce your video. We are an independent service and are not affiliated with the providers of those underlying AI models. We instruct our providers to process this data only to deliver the Service.

6. How We Share Information

We share information only as needed to run the Service:

  • Payment processing: with our merchants of record, Paddle.com Market Ltd and Creem, whichever one handles your order, to process your purchase and provide receipts and billing support.
  • Service providers: with the AI model, rendering, email delivery, content moderation, and hosting providers that operate parts of our pipeline, acting on our behalf.
  • Advertising measurement: with Meta Platforms, to measure and improve the performance of our advertising. This happens in two ways: through the Meta Pixel that runs in your browser, and through the Meta Conversions API, which sends event information directly from our servers. The information shared includes a hashed (irreversible) version of your email address, your IP address, browser and device information, Meta cookie identifiers, and details of the event itself, such as the product ordered and the purchase amount. We never share a child's name, your personalization message, or your video with Meta.
  • Legal and safety: where required by law, to enforce our Terms, or to protect the rights, safety, or security of users, the public, a child, or the Service.

We do not sell or rent personal information, and we do not share a child's name with third parties for their own marketing purposes.

7. Data Retention

We retain order and delivery information for as long as needed to provide the Service, support you, and meet legal, accounting, and fraud-prevention obligations. Generated videos and any associated delivery links are retained only for a limited period; download links may expire, and we encourage you to download and keep your video promptly. Inputs such as a child's first name are retained only as long as reasonably necessary for the purposes described in this Policy and are then deleted or anonymized.

8. Security

We use reasonable technical and organizational measures to protect personal information against loss, misuse, and unauthorized access. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. These measures include encryption in transit and access controls.

9. Children's Privacy

The Service is intended to be purchased and operated by adults. We collect a child's first name (and optional personalization details) only because, and only to the extent that, a parent or guardian provides it to create that child's video. By submitting a child's information, you confirm that you are the child's parent or legal guardian, or are otherwise authorized to provide it, and you consent to our processing it for the purpose of generating and delivering the video.

We do not knowingly collect personal information directly from children or allow children to use the Service independently. If you believe a child has provided us information without appropriate authorization, contact us at hello@getsparkle.video and we will delete it.

Depending on your location, laws such as the U.S. Children's Online Privacy Protection Act (COPPA) and the EU/UK GDPR (including protections for children's data) may apply to this information. You may contact us at any time to access or delete information associated with your order.

10. Your Rights

Depending on where you live, you may have rights to access, correct, delete, or restrict the processing of personal information associated with your order, or to object to certain processing. To exercise any of these rights, contact us at hello@getsparkle.video. We will respond within the time required by applicable law. We respond within one month, extendable where the law allows. You may also have the right to lodge a complaint with your local data protection authority.

You may object at any time to the advertising measurement described in this Policy, including the events we send to Meta from our servers. Email us at hello@getsparkle.video and we will stop sending measurement events associated with you.

11. International Transfers

We are based in Poland. Some of our providers, including our AI, rendering, email delivery, hosting and advertising measurement providers, process data in the United States. Meta Platforms, which we use for advertising measurement, processes data in Ireland and the United States. Where we transfer personal data outside the EEA or the UK, we rely on the European Commission's standard contractual clauses or an adequacy decision.

We may update this Policy from time to time. The "Last updated" date reflects the latest version, and material changes will be posted on this page.
